Dog Bite Law in Pennsylvania

Dog Bites occur more often than people think. They can cause serious injuries, from permanent disfigurement to psychological trauma. There is no such thing as a dog that doesn't bite. In order to prevail on a Dog Bite claim, it must be proven that the dog owner's Negligence was the cause of the victim's injuries.
Pennsylvania Dog Bite Law (Set forth at 3 P.S. § 459, et seq. and known as "The Dog Law") creates categories of victims and treats them differently. Injuries are classified as either severe or non-severe. A "severe injury" is "any physical injury that results in broken bones or disfiguring lacerations requiring multiple sutures or cosmetic surgery. The severely injured victim can make a Dog Law claim against the dog owner for medical expenses and all other damages including pain and suffering. The victim must prove that the dog inflicted severe injury upon him/her without provocation. The non-severely injured victim can only make a claim against the dog owner for medical expenses. The victim only has to prove that the defendant was the owner of the dog.
