Equable Ascent Lawsuits – Have they sued you?

Equable Ascent is a company that buys bad debt to try to make a profit. They are a successor to another of our favorite debt buyers, Hilco. They buy large blocks of allegedly defaulted credit card accounts for a very small fraction of the value, often about 1.5 cents on the dollar for the sole purpose of attempting to collect whatever they can on those accounts from individuals just like you. They file dozens of lawsuits across all of Pennsylvania on a daily basis in hopes of collecting on old debt claims that have been charged off by the original creditor.

We have found that Equable likes to file lawsuits at the District Justice or Magistrate level. The reason for this likely is the cost benefit analysis…they know that if you fail to appear then they don’t have to appear either, and they still win.

Our approach to defending lawsuits filed by Equable Ascent is to force their hand. We defend the case with the understanding that they most likely will not have the documentation that they need to prevail at trial. This is called “a lack of legal sufficiency”. In general, when a party files a lawsuit in Pennsylvania, there are several issues that need to be recited in the lawsuit. In other words, facts must be established that tend to prove that you had a credit account, that you defaulted on it and that Equable Ascent has the right to sue you and collect on the alleged debt. We are also aware that they are very unlikely to provide a witness at the hearing, which is perfect for a defense oriented firm like ours. No witness equals a difficult time proving a case…
